Burnley Borough Council has formally made a new Article 4 Direction

Is Burnley’s New Borough-Wide Article 4 Direction a Portfolio Blocker or an Opportunity?

The landscape for property investment in Burnley is changing. On 25th September 2026, Burnley Borough Council formally introduced a new, non-immediate Article 4 Direction. Once active, this directive will bring the final six unrestricted wards under strict planning controls, effectively making Burnley a borough-wide Article 4 zone for Houses in Multiple Occupation (HMOs)

The Timeline: What You Need to Know

Because Burnley Council has opted for a non-immediate direction, permitted development rights remain active for the next 12 months.

However, the clock is officially ticking.

  • 25th September 2026: The Direction was officially made, and the 6-week statutory public consultation opened.

  • 6th November 2026 (5pm): The public consultation closes.

  • Spring 2027: The Council will review feedback to formally confirm the order.

  • 27th September 2027: The Article 4 Direction comes into full effect. Full planning permission will be mandatory for all new conversions from standard homes (C3) to small HMOs (C4).

The Targeted Wards

Burnley already introduced Article 4 restrictions across nine of its wards in 2024. This new 2026 declaration closes the gap on the remaining six wards:

  • Briercliffe

  • Cliviger with Worsthorne

  • Coalclough with Deerplay

  • Hapton with Park

  • Lanehead

  • Whittlefield with Ightenhill

Council data highlighted a recent surge of new HMOs in these pockets particularly in Lanehead and Coalclough with Deerplay Combined with strict HMO crackdowns in neighboring boroughs, Burnley is acting to prevent displacement investment from flooding these remaining areas.
